Federal Court Mandates Release of Kilmar Abrego Garcia from ICE Detention

A court has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, finding his continued detainment is without legal authority.

"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.

The situation originates in a mistaken removal to El Salvador in March, which the government later acknowledged was an mistake. Following his repatriation to the United States to face alien smuggling allegations, he was detained in federal detention.

In her decision, the court noted that the government lacks a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
